Glossary of Terms

Affidavit of Trust
A copy of select Living Trust provisions which will be helpful in funding and administering your Living Trust.

Anatomical Gift Form
Form for the disposition of your body parts for medical research or transplantation.

Certificate of Trust
A summary of your Living Trust provisions and is useful to open new bank accounts in the Trust name.

Health Care Proxy
The Health Care Proxy is a document in which you appoint selected individuals to make important health care decisions if you are disabled.

Last Will and Testament
The Last Will and Testament is a legal document in which you make provisions to distribute property owned by you at your death. Does not control assets that are owned jointly or assets such as life insurance and retirement accounts that have designated beneficiaries, unless the beneficiary is your Estate.

Living Will
The Living Will is a set of instructions to your physician regarding the removal of life support in the event of a terminal illness.

Per Stirpes
Literally, "by the roots," indicating that a deceased individual's inheritance will pass down the bloodline to children, then up to parents and siblings. Means that a distribution will not be given to the deceased individual's spouse or stepchildren."

Power of Attorney
Document in which you appoint selected individuals to manage non-trust assets if you are disabled or infirm.

Surrogate
The Surrogate is the Judge who presides over the Surrogate's Court.

Surrogate's Court
In New York, Surrogate's Court has jurisdiction over estate and trust matters as well as some guardianships for minors or disabled individuals.

Will
