  1. The age of the child: If the child is more than 14 years old, he or she needs to give consent to the potential adoptive parent.
  2. Parental agreement: Both biological parents need to be given notice of a potential adoption, and they have to give their consent for an adoption to take place. This can become complicated in stepparent adoption matters, as often one biological parent will refuse to give consent. However, a petitioning party may request the court to terminate the parent's rights, if all the requirements to terminate rights under New York law are met.
  3. Involvement from the Department of Social Services (DSS): When the DSS gets involved, usually it has something to do with neglect, abuse or other complicated issues.
