Professional Representation For Your Adoption

Adoption is an important option for many families, including for same-sex couples, for those in remarriage situations and for relatives of divorced couples who cannot provide adequate care for their children. Regardless of your specific details, it is always important to work with an experienced family lawyer to help you through the adoption process.

At Weinstein & Randisi, we take pride in offering personalized, committed legal service in adoptions and other family law matters. Our firm has more than 50 years of experience representing clients in the Rochester area of New York.

Factors That Influence Adoptions

Whether you are dealing with a stepparent adoption or another type of adoption, the person who is adopting is not the most important factor to be considered. There are three important factual questions to consider in any kind of adoption in New York. These are:

  1. The age of the child: If the child is more than 14 years old, he or she needs to give consent to the potential adoptive parent.
  2. Parental agreement: Both biological parents need to be given notice of a potential adoption, and they have to give their consent for an adoption to take place. This can become complicated in stepparent adoption matters, as often one biological parent will refuse to give consent. However, a petitioning party may request the court to terminate the parent's rights, if all the requirements to terminate rights under New York law are met.
  3. Involvement from the Department of Social Services (DSS): When the DSS gets involved, usually it has something to do with neglect, abuse or other complicated issues.

At Weinstein & Randisi, we help clients through all aspects of stepparent or other relative adoptions. In recent years, for example, grandparent adoptions and grandparent custody/visitation matters have become more common than ever, and we also help with cases involving aunts and uncles and other relatives adopting.
